Workshop Waiver and Release – the legal small print

1. I am participating in a event/event (“Event”) provided by EMDR Focus (“Company”) of my own choice and agree to all the terms and conditions of this Waiver and Release (“Agreement”).

2. I understand and agree that all Event content is strictly confidential. All instruction, commentary, text, video, materials, questions, answers, comments, and other content contained in or related to the Event, whether provided by instructors, faculty, staff, or participants (collectively, “Confidential Information”) is and will remain confidential. I will not disclose any Confidential Information to any other party except as necessary and practical in my individual therapy practice. I will not make any recording of any portion of the Event. I will not duplicate, reproduce, distribute, publish, or display any of the Confidential Information.

3. I understand and agree that the Company may record the Event and also that, unless I explicitly request otherwise, the Company may use or share such recordings, including my own participation, for further Company events, workshops, webinars and education.

4. ”Materials” means all printed, audio, video, digital, online, and other materials used in and in connection with the Event, all duplicates, reproductions, and derivatives of these items, and anything created by the Company and related to the Event. I understand and agree that the Company owns and retains all rights to the Materials and all intellectual property used or referenced in the Event including, but not limited to, copyrights and trademarks. I understand that I do not have any rights to the Materials other than to use them in connection with the Event and the learnings I take from that.

5. In the event of inappropriate or disruptive behaviour, the Company or its authorised agent or representative may request that I leave the Event and the Event premises/online space. I release any and all claims against the Company related to any discontinuation of my participation or involvement in the Event.

6. I will not make, cause to be made, or encourage any third party to make any disparaging or negative statement about the Company, Event, facilitators, or trainers, nor any statement which might damage the Company’s reputation, brand, facilitators, facilitators, workshop leaders, or contractors.

7. I understand and agree that the Company does not warrant, guarantee, or make any representations about the Event. The Company disclaims all warranties with respect to the Event, either express, implied, or statutory, including but not limited to the implied warranties of merchantability, of satisfactory quality, of fitness for a particular purpose, and of accuracy.

8. I release the Company and all its respective agents, affiliates, officers, directors, contractors, and employees (collectively “Released Parties”) from all claims and expenses (including attorney’s fees) on account of any injury or damage caused or alleged to be caused by the Released Parties or any other party’s action, inaction, or negligence in connection with the Event. I indemnify and hold harmless the Released Parties from any and all third-party claims, demands, losses, damages, and expenses related to my action, inaction, or negligence.

9. This Agreement supersedes all prior agreements, oral or written, regarding its subject matter. If any portion of this Agreement is judged invalid or unenforceable, it will be enforced to the maximum extent permitted by law. This Agreement is governed by the laws of England in the United Kingdom, and the parties consent to the exclusive jurisdiction of the courts of England.
